~~~ 5 Nov: Pavement obstruction from overgrown plants, hedges or trees (AA) Where access on a pavement is obstructed by overgrown plants, hedges or trees, the Council can offer to write to the landowner to ask that overgrown foliage is cut back. A preliminary inspection must be carried out by a Roads Inspector to establish if there are statutory grounds (based on Section 91 of the Roads (Scotland) Act 1984) on which to issue a formal notice to the owner to remedy the problem.
